LADIES AND GENTLEMEN,
On May 25, 2018, new data protection regulations will come into force. These rules are set in Regulation (EU) 2016/679 of the European Parliament and of theEuropean Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (known as the R0DO - Personal Data Protection Regulation or GDPR - General Data Protection Regulation). This Regulation introduces a uniform law on personal data protection in all Member States of the European Union and thus also in Poland.

The new regulations are to increase the personal data protection of data subjects through, among others:

The right to be forgotten - in a situation in which a person does not want his/her data to be processed and there is no basis for such processing. As the European Commission points out, this tool is supposed to protect the privacy of individuals, not necessarily allow for removing information from the past or restricting press freedom.

Easier access to data - data subjects will have access to a wider range of information about the processing of their data and this information should be available in a clear and understandable form. In addition, the right to data portability is to allow data subjects to transfer data between Internet service providers.

Data breach notification obligation - Controllers are required to notify the supervisory authority and, where appropriate, the data subject of a data breach.
-
Need to implement data protection mechanisms in the design phase and data protection by default - this means, for example, that the protection of personal data is to be taken into account already at the stage of the creation of an online service and that default data protection settings ensuring the minimization of processed data should become the standard, for example on social networking sites.

Stronger children's rights protection - according to the regulation, children's personal data deserve special protection because they may be less aware of the risks, consequences, guarantees and their rights in relation to the processing of personal data. In the context of information society services offered directly to children, the Regulation provides that the consent to the processing of data of a child under the age of 16 must be given or approved by the person having parental authority or custody of the child and only to the extent of the consent. It is also worth noting that Member States may lower the age limit indicated above and set a lower limit, which must be at least 13 years old.

Better compliance with the applicable regulations - the Polish data protection authority will be able to impose administrative fines of up to €20 million or up to 4% of total annual global turnover.

Processing of personal data is compliant with the legal requirements when:

educational activity (student enrolment, educating students of 1st, 2nd and 3rd cycle studies, training of academic staff),

Regulations of the e-learning platform of Czestochowa University of Technology
These regulations define the principles of using the e-learning platform of Czestochowa University of Technology and services related to it, the rights and obligations of the User and the rights and obligations of Czestochowa University of Technology related to the provision of services in accordance with the provisions of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2017.1219, i.e. of 2017.06.24 as amended).

§1 GENERAL PROVISIONS

By using the e-learning platform of Czestochowa University of Technology you accept the rules of these regulations.
-
The owner of the e-learning platform e-learning.pcz.pl is Czestochowa University of Technology, address: 69 Dąbrowskiego Street, 42-201 Częstochowa.
-
The Platform's administrator is MSK-CzestMAN.
-
The applicable regulations are available at the address: https://e-learning.pcz.pl. Users can download it at any time and make a printout from it.
-
The provisions of the regulations and any consequences arising from them are subject to the jurisdiction of Polish law and Polish common courts.
§2 DEFINITIONS
-
The e-learning platform of Czestochowa University of Technology e-learning.pcz.pl, hereinafter referred to as the PCz e-learning platform, is a collection of e-learning courses, placed on a web server, with the use of moodle software, supporting teaching processes, including the implementation of study programmes within the educational activity of Czestochowa University of Technology, hereinafter referred to as the University.

The moodle software is an Internet application providing the Users with the possibility of using virtual space for posting materials, communication and interaction with the system and among Users.

The Users of the PCz e-Learning Platform may be students, post-graduate students and students of other courses/trainings provided by Czestochowa University of Technology, academic teachers of the University, as well as guests, i.e. people who may have access to selected resources without the need to log in.
-
The users of the e-Learning Platform may also be University employees who are not academic teachers and whose scope of duties is related to the service of students and academic teachers.

On the PCz e-learning platform, appropriate categories of Users are in force, depending on their rights:
-
a guest /visitor- a User using the resources of the Moodle platform without an account on it.
-
a student - a User who is a student of the University, a student of post-graduate studies or a student of other courses/trainings realised by Czestochowa University of Technology, who has an account on the PCz e-learning platform with basic privileges enabling him/her to sign up for courses dedicated to him /her and interact with materials included in the courses and communicate with other Users of the platform having an account,
-
the course instructor - a User with the right to create courses, to place factual content and to run courses assigned to him/her,
-
manager - a User who has the right to manage courses, categories and Users within the areas designated by the administrator,
-
administrator - an employee of Czestochowa University of Technology, dealing with the management of the platform users' accounts, administration of the IT system, technological modifications of the platform aimed at adapting it to the needs and requirements of the users.

§3 USER ACCOUNT

Creating an account on the PCz e-learning platform is free of charge. By registering, the User is able to use the platform's functionalities.
-
In order to create an account, it is required to provide the unique name of the User, a correct and functioning e-mail address belonging to the User, a password to access the Platform and the name and surname of the account owner.
-
It is prohibited to use e-mail addresses that may violate the rights of third parties.
-
The User undertakes to provide true data during the registration process. It is also possible to set up an account by the System Administrator on the basis of data provided personally by the User.
-
In order to log in to your account you are required to provide a valid user name or e-mail address used during registration and the password.
-
Only one user can use one account.
-
If the User forgets his/her password, he/she can use the "Forgot password" option available in the login window of the PCz e-learning platform.
§4 RIGHTS AND DUTIES OF THE PARTICIPANTS OF THE DISTANCE LEARNING PROCESS

The platform administrator is an employee of Czestochowa University of Technology authorized by the Administrator of Personal Data (ADO), who, as the system maintainer:
-
provides support for persons using the PCz e-learning platform in the scope of selected issues related to technical and methodical aspects of its functioning,
-
manages users' rights on the platform, in particular can assign the rights of the course leader and the manager on the basis of applications and after appropriate verification,
-
manages teacher training courses, which prepare lecturers to conduct classes with the help of distance learning methods,
-
is responsible for fully functioning system and tailoring the CUT e-learning Platform capabilities to the needs of its users,
-
optimises the structure of the Platform to ensure proper functioning,
-
has full permissions to incorporate the changes into the system; set up, modify and delete the users’ accounts,
-
has full permissions to set up new files and courses,
-
determines the allowable size and format of the uploaded files,
-
tests and installs applications on the CUT e-learning Platform which are required to teach courses, as well as to develop multimedia and interactive materials; and adjusts the graphics and layout of the information available for the Platform users,
-
determines the rules for data authentication transmission and dissemination,
-
processes personal data like: forename, surname, e-mail address, which are necessary to register the users for courses,
-
develops the proposed changes to the CUT e-learning Platform regulations,
-
protects and carries out regular Platform safety tests.

A Course Leader is a user who is either an employee or an associate of CUT. The Course Leader (with permission to set up, edit and modify the course content) is the course controller with rights to change its content, along with setting up participation requirement and evaluation criteria. Their permission allows them to create: training materials using distance-learning methods and techniques, groups of participants and their access level. The Course Leader is fully responsible for all the course content published, which should be compatible with the rule of law including the act from 4 February 1994 on the Intellectual Property rights and related acts – Dz.U. 2017.880 from 2017.05.05 as amended.

The Course Leader provides the participants with the information such as: classes schedule, evaluation criteria, final exam requirements etc.

The Course Leader can grant permissions to other users to upload and modify course content.

In order to request the same level of permission as a Course Leader, you need to send your request to the Platform administrator via e-mail.

A Student is a person who is studying undergraduate or postgraduate course at CUT or attending other courses conducted by CUT and has CUT e-learning Platform account or has the access to the system via a login and a password.

A student is obliged to:

provide true personal data and confirm that they read and understood the regulation of the CUT e-learning Platform through acceptance of the Terms and Conditions,
-
must not provide third parties with the login and password granted by the administrator to access the platform and courses,
-
must not provide through the platform any material that is unlawful, including copyright, social and moral norms or that may encourage other course participants to behave in a way that constitutes a criminal offence or violation of law,
-
must not attempt to crack the password of other Participants or to obtain unauthorized access rights,
-
must not share, in particular on other platforms and websites, materials downloaded from the CUT e-learning platform.

The student has the right to:

access and rectify, modify the personal data and exercise the rights vested under general law provisions,
-
use the materials offered as part of courses on the CUT e-learning platform, to which he/she obtained the right of access,
-
place materials required by the courses in which they participate,
-
delete the account or the data placed in it one year after the end of the programme of study.

A guest is a person who has the right to use the platform resources to an extent limited by the coordinator, administrator and course instructors without logging into the system.
§ 5 PROTECTION OF COPYRIGHT

The platform user bears full responsibility for the content posted by him/her, and in particular he/she bears the responsibility arising from the Act of 4 February 1994 on Copyright and Related Rights.

The user is allowed to post on the platform only works or extracts thereof, to which he/she has the appropriate right (property copyright or license in a given field of use), and in particular in relation to which:
-
he/she holds moral rights as well as property copyright (posted by creators),
-
property copyright or a license to use it is held by Czestochowa University of Technology, where the right covers at least the reproduction and distribution of the said works on the Internet,
-
he/she holds property copyright or a license to use it under contracts for the transfer of rights or on the basis of granting licenses concluded with third parties, covering at least the reproduction and distribution of the said works on the Internet,
-
property copyright has expired.

The User is allowed to post materials that are not protected by legal copyright, provided that other property rights to these materials are respected.
-
If the administrator receives reliable information about infringement of copyright or related rights, the account is blocked and the authorities of the University's unit where the person is employed or studying are notified.

Users may use the materials posted on the internet platform only for their own syllabus-based educational purposes, in compliance with the provisions of the Act of February 4, 1994 on copyright and related rights (the register Dz. U. of 2017.880, i.e. 2017.05 .05 with subsequent amendments).

Modifying, copying, sending, public performance and any use of the contents posted on the platform for commercial purposes requires respecting intellectual property rights. Users are fully liable for any damage due to their action contrary to the above reservation.

Materials and statements posted by users may be modified or deleted by the course teacher, manager, administrator, if they are considered inconsistent with the provisions of these regulations or generally applicable law. This applies in particular to statements and materials not related to the syllabus.

Materials and statements may not contain indecent, offensive or obscene contents.
-
The Częstochowa University of Technology (CUT) reserves the right not to give consent to dissemination, modification or transmission, reproduction, printing, public reproduction of texts, graphics, animations, sounds and other materials available through the platform.
§6 THE USE OF USERS E-MAIL ADDRESSES

E-mail addresses collected in the platform's database are used for:

Authorization and identification of users on the CUT e-learning platform

Sending messages related to:

operation and organization of the course,
-
interaction with substantive materials,
-
platform administration.

Messages can be:

generated automatically by the course components on the platform,

sent by other users, in particular:

course instructors,

managers,

administrator.

Messages sent may concern directly the course, didactic process or the organization of classes.
§7 PRIVACY POLICY

The administrator of the e-learning Platform is Czestochowa University of Technology with its registered office in Częstochowa at ul. Dąbrowskiego 69, 42-201 Częstochowa.

The CUT e-learning Platform performs the functions of obtaining information about users and their online presence in the following way:

by information entered voluntarily in forms,
-
by saving cookie files in end devices (so-called ‘cookies’),
-
by collecting web server logs,
-
by collecting information provided voluntarily by the User.

The platform may also save information about connection parameters (time-stamp, IP address)
-
Information about some of the behaviours of users are subject to logging in the server layer. This data is used only to administer the Platform and to ensure the most efficient service provided.

The browsed resources are identified by URL addresses. In addition, the following may be saved:

the time of receipt of the inquiry,
-
the time of sending the answer,
-
the name of the client station - identification carried out by the HTTP protocol,
-
information about errors that occurred during the implementation of the HTTP transaction,
-
the URL address of the page previously visited by the user (referrer link) - if the Platform was accessed via a link,
-
information about the User's browser,
-
information about the IP address.

The above data is not associated with specific people browsing the website.
-
The above data is used only for server administration purposes.
-
Data enabling the identification of a natural person are made available only with the consent of that person or under generally applicable provisions of the law.

The operator may be required to provide information collected by the Platform to authorized bodies on the basis of lawful requests to the extent justified by the request.
§8 DELETING ACCOUNTS

The administrator responsible for the functioning of the platform stores the data of:

Students, along with the history of their activity and materials posted during the period of their studies. After removing the student from the student list, the account is blocked (inactive) and the data is deleted after a period of three years.

Employees, with the history of their activity and materials posted during the period of work for Czestochowa University of Technology. After the end of cooperation with Czestochowa University of Technology or in the case of accounts inactive for a period of three years, the data is deleted.

§9 INFORMATION ON PERSONAL DATA PROTECTION AND PROCESSING

The Personal data collected on the CUT e-learning Platform is processed in accordance with the following regulations: Regulations of the European Parliament and the Council (EU) 2016/679 of the 27th of April, 2016 on the protection of individuals as regards the processing and flow of personal data, Repealing of Directive 95/46 / EC (on general regulation on the protection of personal data), the Act of the 10th of May, 2018 on the protection of personal data (i.e. Journal of Laws of 2018, item 1000), Act of the 16th of July 2004 on Telecommunications Law (Journal of Laws 2017.1907, i.e. of 2017.10.1, with later amendments).

The Personal Data Controller (PDC) of the data stored and processed on the CUT e-learning Platform is the Czestochowa University of Technology, represented by his Magnificence Rector, which is based at ul. Dąbrowskiego 69, 42-201 Czestochowa.

For communication the Personal Data Controller has appointed a Personal Data Inspector, who can be contacted on the phone 34 325 04 71, by e-mail iodo@pcz.pl or using the Personal Data Controller’s contact details.

The purpose of the data processing on the platform provides the service of the platform and the service of the courses including recruitment, monitoring and e-learning supervision.

Personal data of the User of the CUT e-learning Platform in the scope of: Name, Surname, Student No., e-mail address, necessary for the correct implementation of the courses is provided to the Course Leader, referred to in §4 point 2.

Provision of personal data is voluntary for the User of the CUT e-learning Platform, but the consequence of not providing it will result in inability to participate in a course.

The data provided in the profile form is aimed to support the teaching processes and/or technical services introduced by the platform administrator.

The user of the CUT e-learning Platform has the right to:

access their personal data, rectify, delete or limit the processing, disagree with the processing, transfer their data, if the processing is not necessary for the administrator to fulfil their legal duties and there are no legally higher grounds for them,
-
withdraw his consent to the processing of their data if there are no other legal grounds for the processing,
-
lodge a complaint to the supervisory body - the President of the Personal Data Protection Office, regarding the breach of the rules of personal data protection.

Personal data of the User of the CUT e-learning Platform is stored for a period of one year after the studies, and then they are deleted.
§10 FINAL PROVISIONS

The Częstochowa University of Technology in Częstochowa reserves the right to amend these regulations. Possible changes will be published on the CUT e-learning Platform. Platform users will be notified of the changes via an appropriate message on the website at the beginning of the login process to the CUT e-learning Platform.

Anybody using the services or data on the platform is obliged to comply with above regulations.

Failure to comply with the regulations is tantamount to the loss of the right to use the platform.
